These Terms of Use ("Terms") govern your use of this website, divebase.io (the "Site"). The Site is the marketing and early-access website for Dive Base, a product launching in 2026. The Site and Dive Base are operated by Adler Net UG (haftungsbeschränkt), Courbierestraße 9, 10787 Berlin, Germany ("we", "us", "our"). You can reach us any time at info@divebase.io. By using the Site, you agree to these Terms.

Acceptance

If you do not agree with these Terms, please do not use the Site. We may update these Terms from time to time, and the version published on this page is the one that applies to your use.

About this site

This is a marketing and early-access website. It tells you about Dive Base and lets you ask for early access. The product itself is not yet available, and the details on this site, including features and prices, may change before launch.

Who may use this site

The Site is intended for dive centers, liveaboards and other businesses, and for people who are at least 16 years old. By using the Site you confirm that you meet these conditions. If you use the Site on behalf of a business, you confirm that you are allowed to act for it.

Permitted use and conduct

You may use the Site to read about Dive Base and to contact us. You agree not to:

• use the Site in any unlawful way, or in a way that harms others;
• try to break, overload, disrupt or gain unauthorised access to the Site or its systems;
• copy, scrape or harvest data from the Site by automated means beyond normal search-engine indexing and what our robots file allows;
• reverse engineer, probe or test the security of the Site without our written permission;
• submit false information, or another person's information without their permission;
• upload anything that contains malware or that infringes the rights of others.

The early-access form

You can ask for early access through the form on the Site. Sending the form does not guarantee that you will be given access, a place in any programme, or any particular price. You agree that the information you give us is accurate and that you are allowed to share it. We handle your details as described in our Privacy Policy.

Intellectual property

The Dive Base name, the Dive Base logo, and the text, design, graphics and code on the Site belong to Adler Net UG (haftungsbeschränkt) or its licensors and are protected by law. You may not copy, change, distribute or reuse them without our written permission, except as the law allows. Using the Site does not give you any right in our trademarks or content.

Third-party links

The Site may link to websites we do not control. We provide these links for convenience only and are not responsible for the content, products or privacy practices of those sites. Visiting them is at your own risk.

No warranty

The Site is provided "as is" and "as available". We do our best to keep it correct, secure and up to date, but, as far as the law allows, we do not promise that it is free of errors, that it will always be available, or that any information about the future product is final. Anything about the product, including features and prices, may change.

Limitation of liability

We are fully liable for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only where we breach an essential contractual obligation (an obligation whose fulfilment makes proper performance possible and on which you may normally rely), and in that case our liability is limited to the foreseeable, typical damage. Any further liability is excluded as far as the law allows. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, and your mandatory rights as a consumer are not affected.

Indemnity

If your unlawful use of the Site, or your breach of these Terms, causes a third-party claim against us, you agree to be responsible for it to the extent the law allows and to the extent you are at fault.

Data protection

We handle your personal data as described in our Privacy Policy and our Cookie Policy.

Governing law and jurisdiction

These Terms and your use of the Site are governed by the law of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not take away the protection given to you by the mandatory laws of the country where you live. To the extent the law allows, the place of jurisdiction for disputes with merchants is Berlin, Germany; consumers may bring or face claims in the courts that the law assigns to them.

Consumer dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (section 36 of the German Consumer Dispute Resolution Act, VSBG). Please contact us first at info@divebase.io and we will try to resolve any concern directly.

Severability

If any part of these Terms is found to be invalid or unenforceable, the rest stays in force, and the invalid part is replaced by a valid rule that comes as close as possible to its original purpose.

Changes

We may change these Terms as we get ready for launch. When we make an important change, we will update the date at the top of this page.

Separate terms for the product

These Terms cover this website only. When Dive Base launches, a separate service agreement and data processing terms will apply to the use of the product itself.
